These Terms & Conditions (“Terms”) govern your access to and use of our website at https://mayratours.com/ (the “Website”), as well as any bookings, services, or tours arranged through us (collectively, the “Services”). By accessing the Website, making a booking, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or our Services.

These Terms form a legally binding agreement between you (the “Customer,” “you,” or “your”) and Mayra Tours, a travel agency based in Dubai, United Arab Emirates. We reserve the right to update these Terms at any time, with changes effective upon posting on the Website. Your continued use of the Services after such changes constitutes acceptance.

1. Booking and Reservations

  • Eligibility: You must be at least 18 years old to book Services on behalf of yourself or others. By booking, you represent that you have the authority to bind all participants.
  • Process: Bookings are subject to availability and confirmation. Upon submission, you will receive a confirmation email. All bookings are provisional until full payment is received and confirmed by us.
  • Accuracy: You are responsible for providing accurate information, including passenger details, dates, and special requirements. Errors may result in additional fees or cancellation.
  • Group Bookings: For groups of 10 or more, special terms may apply, including minimum numbers and surcharges.

2. Payments

  • Methods: We accept payments via credit/debit cards, bank transfers, or other secure methods listed on the Website. All payments are processed in AED (United Arab Emirates Dirham) unless otherwise specified.
  • Deposits and Balances: A non-refundable deposit (typically 30-50% of the total) is required at booking. The balance is due 14 days prior to the tour start date, or immediately for last-minute bookings.
  • Currency and Fees: Exchange rates and processing fees are your responsibility. We are not liable for fluctuations or third-party charges.
  • Failed Payments: Bookings may be canceled if payments are not received on time, subject to our cancellation policy.

3. Cancellations and Refunds

  • By Customer:
    • More than 30 days before start: Full refund minus deposit and any non-refundable supplier fees.
    • 15-30 days before start: 50% refund of total amount.
    • 7-14 days before start: 25% refund.
    • Less than 7 days or no-show: No refund.
  • Amendments: Changes to bookings (e.g., dates, names) may incur a fee of AED 100-200 per amendment, plus any supplier charges.
  • By Us: We reserve the right to cancel or alter Services due to unforeseen circumstances (see Force Majeure below). In such cases, we will offer a full refund or alternative options. We are not liable for additional costs (e.g., travel to/from the tour).
  • Insurance: We strongly recommend travel insurance covering cancellations. Refunds are at our discretion and subject to supplier policies.

4. Tour Participation and Conduct

  • Health and Fitness: Tours may involve physical activity, heat, or other conditions. You must disclose any medical conditions that could affect participation. We reserve the right to refuse entry for safety reasons.
  • Behavior: You agree to comply with all laws, instructions from guides, and respect local customs. Disruptive behavior may result in removal from the tour without refund.
  • Minors: Children under 18 must be accompanied by a responsible adult. Age restrictions apply to certain activities (e.g., desert safaris).
  • Prohibited Items: Weapons, illegal substances, or hazardous materials are not permitted.

5. Liability and Disclaimers

  • Our Liability: We act as an intermediary for third-party providers (e.g., hotels, transport, activity operators). We are not liable for their acts, omissions, or failures. Our total liability is limited to the cost of the Services booked.
  • Exclusions: We are not responsible for personal injury, loss of property, delays, or consequential damages, except where caused by our gross negligence. You assume all risks associated with travel, including health risks, terrorism, or natural disasters.
  • Website Use: Content on the Website is for informational purposes only and may contain errors. We disclaim warranties of accuracy or completeness.
  • Indemnity: You agree to indemnify us against claims arising from your breach of these Terms or misuse of Services.

6. Force Majeure

We are not liable for failure to perform Services due to events beyond our control, including but not limited to acts of God, war, strikes, pandemics, government restrictions, weather, or supplier insolvency. In such cases, we will notify you and offer alternatives or refunds where possible.

7. Intellectual Property

All Website content, logos, and materials are owned by us or our licensors. You may not reproduce, distribute, or use them without written permission, except for personal, non-commercial use.

8. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved exclusively in the courts of Dubai. You agree to submit to their jurisdiction.

9. Miscellaneous

  • Severability: If any provision is invalid, the remainder remains in effect.
  • Waiver: No waiver of any breach shall constitute a waiver of subsequent breaches.
  • Entire Agreement: These Terms supersede prior agreements.
